How to enroll your contract in the House Court Kavach?
1. Include the following House Court Arbitration Clause in your contract:
“Any dispute, controversy or claim arising out of or relating to this contract, including its construction, meaning, scope, or validity thereof, shall be settled by arbitration under the Arbitration and Conciliation Act, 1996, as amended from time to time, by a sole Arbitrator appointed from a panel of three Arbitrators made available by the House Court Dispute Resolution Platform (www.housecourt.in).
The House Court Platform will make a panel of three arbitrators available to the Party raising the dispute, within three days of it’s raising the dispute on the House Court Platform.
The party raising the dispute shall intimate the other party that it has raised a dispute, and shall also provide the other party with the panel made available by House Court.
If the Parties are unable to agree on the appointment of the arbitrator within 30 days of the notice being received by the other party (notice period), the person whose name appears first on the panel made available by House Court shall be deemed to be appointed.
The arbitration proceedings shall be conducted as per the House Court dispute resolution process, and shall commence within three days of the expiry of the notice period.”
2. Click here to upload your signed contract and enroll it into House Court Kavach. It is free of cost (for a limited time only)
Once you submit your contract, it will automatically be assigned a contract code and will be stored in an encrypted vault.
When there is a dispute arising out of the contract, all you have to do is register the dispute at this link <https://housecourt.in/kavach-dispute-registration/> with the contract code. You will be given free of cost access to lawyers from the House Court Panel and you may appoint one to implement the Kavach. You may also choose to use your own lawyer. In case House Court is not able to accept your case, you can go to court to have an arbitrator appointed.
The lawyer must send a notice according to our template available at this link <https://housecourt.in/kavach-arbitration-invocation-notice-template/>. The platform may subsequently be used to get an enforceable award in as little as three months.
The award will happen irrespective of whether or not the Defendant participates in the arbitration proceedings.
