Anand Arora lived in Vasant Vihar, Delhi, with his parents, wife, and daughter. Anand purchased health insurance worth Rupees 20 lakhs from Sunbeam Insurance Company in July 2009. He did so after giving full disclosure of all his existing medical conditions. When Anand contracted jaundice in October 2009, and his condition did not improve, doctors advised hospitalization. When his symptoms deteriorated, the hospital conducted a lot of tests to diagnose the problem. The tests revealed that he had a tumor-like growth on his back, which required surgery. The hospital treated Anand’s jaundice and performed the surgery to remove the tumor.
On the day he was discharged, Anand was extremely relieved to have health insurance when he saw the Rupees eight lakh hospital bill. However, to his utter shock, Sunbeam refused to pay his hospital bills. Sunbeam contended that Anand failed to disclose the tumor when he purchased his insurance policy, even though it was detected after hospitalization. With no other option, Anand had to loan money from relatives and friends to foot the Rupees eight lakh hospital bill.
Outraged by Sunbeam’s conduct, Anand decided to approach the Consumer Court and sue them for compensation and damages. The case dragged on for years and took up a lot of Anand’s money, time, and energy. Finally, after six years of pursuing the case, the Court passed a judgment in Anand’s favor. The Court awarded him an amount of Rupees 40 lakhs as compensation and damages. Unfortunately, Anand never lived to see the money. He died sixmonths before the Court passed its judgment.
Had Anand opted to resolve the dispute through an online justice platform, the case would have taken only a few months to conclude and would have cost much less. Better still, Anand would not have had to travel for Court hearings.
